Florida law allows a statutory procedure for Contractors to secure their right to payment by their customer through use of a Construction Lien (see Section 713, Florida Statutes). Unlike other states, Florida Contractors enjoy the right to a construction lien simply by virtue of performing labor or services, or furnishing materials. However, it’s a “use it or lose it” situation—a failure to strictly comply with the time, notice, and filing requirements will often invalidate an otherwise enforceable lien.
