Legal Alert: Florida’s Minimum Wage set to Increase on September 30, 2024
Starting September 30, 2024 the minium wage for non-tipped employees will increase to $13 per hour.
Florida's minimum wage is set to rise again at the end of this month as part of a constitutional amendment passed in 2020. This change will take effect on September 30, 2024, when the minimum wage for non-tipped employees will increase from $12 per hour to $13 per hour. Tipped employees will see their minimum wage rise to $9.98 per hour. The state's minimum wage will continue to increase by $1 each year until it reaches $15 per hour by 2026. For tipped workers, the wage will similarly increase until it hits $11.98 per hour by 2026.
Employers should plan on printing out and displaying the updated Minimum Wage Poster at their offices no later than September 30th.
The stated goal behind this gradual wage increase is to ensure fair compensation for workers across Florida while providing businesses with a predictable schedule to prepare for higher payroll expenses. However, compliance is critical for employers. Failure to adhere to these new rates could result in substantial penalties, including fines and back wages owed to underpaid employees. Employers must update payroll systems and post the revised minimum wage notice where employees can easily see it.
For businesses, ensuring compliance with both state and federal wage laws is crucial. It is also important to be aware of local wage theft ordinances, which may impose stricter penalties than state laws in certain Florida counties, such as Miami-Dade. Businesses are advised to review their payroll practices and legal obligations closely before the new wage hike.
If you have questions about how this wage increase affects your business, it is advisable to consult with a legal expert to ensure you remain compliant and avoid costly litigation.
